Submit a Petition to Appeal an Agency’s Rulemaking Decision

If a state agency denies your petition to repeal or amend an existing rule, you may appeal the agency’s denial of your petition to the Governor.  RCW 34.05.330(3)

Please note:

  • You must petition the agency first.  The Governor may only consider an appeal after the agency denies a petition.
  • The Governor is not authorized to consider appeals related to petitions to adopt a new rule.  He may only consider appeals of denied petitions to amend or repeal an existing rule.
  • Your appeal must be submitted within 30 days of the agency’s denial of your petition. 

To submit your appeal to the Governor,  we encourage you to do so by letter (sent via regular mail) or email.

Your appeal must be submitted within thirty (30) days of the agency’s denial. The Governor’s Office will respond to your appeal within 45 days of receipt.   

Required items: 

  • Appeal request, sent via webform, regular mail/letter or email. 

Suggested items to include:

  • Agency’s denial letter
  • Petition submitted to agency
  • Supporting documents, if any

Note:  If you do not submit the original petition to the agency or the agency’s denial letter along with your appeal, we will request those documents from the agency.
